CLAUSES OF PROGRAMME AND PROGRESS

工期總?cè)諝v天數(shù)： 天。工期總?cè)諝v天數(shù)與根據(jù)前述計劃開竣工日期計算的工期天數(shù)不一致的，以工期總?cè)諝v天數(shù)為準(zhǔn)。

The total calendar days for work: days. In case of inconsistency between total calendar days with the scheduled days from commence to completion, the total calendar days will be prevail.

Progress Reports進(jìn)度報告

Unless otherwise stated in the Particular Conditions, monthly progress reports shall be prepared by the Contractor and submitted to the Employer in six copies. The first report shall cover the period up to the end of the first calendar month following the Commencement Date. Reports shall be submitted monthly thereafter, each within 7 days after the last day of the period to which it relates.

除非專用條件中另有規(guī)定,承包商應(yīng)編制月進(jìn)度報告,一式六份,提交給雇主.第一次報告所包括的期間,應(yīng)自開工日期起至當(dāng)月的月底止.以后應(yīng)每月報告一次,在每次報告期最后一天后7日內(nèi)報出.

“進(jìn)度計劃”是指承包商根據(jù)第12.1款提交的進(jìn)度計劃以及任何批準(zhǔn)的對進(jìn)度計劃的修訂。

"Programme" means the Programme to be submitted by the Contractor in accordance with Sub-Clause 12.1. and any approved revisions thereto.

The Contractor shall submit to the Engineer for his approval the Programme which shall contain the following:

承包商應(yīng)在開工日期之后28天內(nèi)按序言規(guī)定的格式提交進(jìn)度計劃。

The Contractor shall submit the Programme in the form stated in the Preamble within 28 days after the Commencement Date.

工程師對該進(jìn)度計劃的批準(zhǔn)不應(yīng)解除合同規(guī)定的承包商或業(yè)主的任何義務(wù)。

The approval by the Engineer of the Programme shall not relieve the Contractor or the Employer from any obligation under the Contract.

修改進(jìn)度計劃

Revision of Programme

如果工程的進(jìn)展不符合進(jìn)度計劃時，工程師可指示承包商修改進(jìn)度計劃。如果要求作出上述修改的原因不是由承包商負(fù)責(zé)時，工程師應(yīng)為編制修改的進(jìn)度計劃之費(fèi)用開具證明，并將之加到合同價格中。

If the progress of the Works does not conform to the Programme, the Engineer may instruct the Contractor to revise the Programme. If such modifications are required for reasons for which the Contractor is not responsible, the cost of preparing the revised Programme shall be certified by the Engineer and added to the Contract Price.

若在任何時候承包商的實際進(jìn)度落后于第4.14款所指明的進(jìn)度計劃，或很明顯將落后于該進(jìn)度計劃，則承包商應(yīng)向雇主代表提交一份考慮到當(dāng)前情況的修訂的進(jìn)度計劃。承包商應(yīng)同時將正在采取的為加快施工進(jìn)度，以便在竣工時間內(nèi)完工的步驟通知雇主代表。

If, at any time, the Contractor’s actual progress falls behind the programme referred to in Sub-Clause 4.14, or it becomes apparent that it will so fall behind, the Contractor shall submit to the Employer?s Representative a revised programme taking into account the prevailing circumstances. The Contractor shall, at the same time, notify the Employer?s Representative of the steps being taken to expedite progress, so as to achieve completion within the Time for Completion.

Programme

The Contractor shall submit a programme to the Employer?s Representative, for information, within the time stated in the Appendix to Tender. The programme shall include the following:

進(jìn)度計劃

在投標(biāo)書附錄中規(guī)定的時間內(nèi)，承包商應(yīng)向雇主代表提交一份進(jìn)度計劃，供其參考。進(jìn)度計劃應(yīng)包括下列內(nèi)容；

（a）承包商計劃實施工程的次序（包括設(shè)計、采購、制造、貨物運(yùn)達(dá)現(xiàn)場、施工、安裝、檢驗和試運(yùn)行的各個階段）；

(a) the order in which the Contractor proposes to carry out the Works (including each stage of design, procurement, manufacture, delivery to Site, construction, erection, testing and commissioning),

（b）施工文件編制中包含的所有主要事件與活動；

(b) all major events and activities in the production of Construction Documents,

?

（c）根據(jù)第5.2款進(jìn)行施工前審查的期限以及在雇主的要求中規(guī)定的其他提交、批準(zhǔn)和同意的期限；

(c) the periods for the pre-construction reviews under Sub-Clause 5.2 and for any other submissions, approvals and consents specified in the Employer’s Requirements, and

（d）合同中規(guī)定的所有檢驗的次序。除合同另有規(guī)定外，此類進(jìn)度計劃的編制應(yīng)采用前導(dǎo)網(wǎng)絡(luò)技術(shù)，標(biāo)出最早開始、最遲開始、最早結(jié)束、最遲結(jié)束的日期。

(d) the sequence of all tests specified in the Contract. Unless otherwise stated in the Contract, the programme shall be developed using precedence networking techniques, showing early start, late start, early finish and late finish dates.

不論雇主代表何時要求，承包商均應(yīng)以書面形式提供一份為實施工程承包商計劃采用的安排和方法的總體說明，供其參考。在未通知雇主代表的情況下，進(jìn)度計劃或此類安排與方法都不應(yīng)有重大更改。若工程進(jìn)展與進(jìn)度計劃不符，雇主代表可通知承包商修改進(jìn)度計劃，指出為在竣工時間內(nèi)完成工程須作的必要更改。

The Contractor shall, whenever required by the Employer’s Representative, provide in writing, for information, a general description of the arrangements and methods which the Contractor proposes to adopt for the execution of the Works. No significant alteration to the programme, or to such arrangements and methods, shall be made without informing the Employer?s Representative. If the progress of the Works does not conform to the programme, the Employer?s Representative may instruct the Contractor to revise the programme, showing the modifications necessary to achieve completion within the Time for Completion.

進(jìn)度報告 Progress Reports

承包商應(yīng)編制月度進(jìn)度報告，并將6份副本提交給雇主代表。第一份報告所包含的期間應(yīng)從開工日期起至開工日期所在月歷的最后一天止，此后每月均應(yīng)在該月最后一天之后的14日內(nèi)提交月度進(jìn)度報告。報告應(yīng)持續(xù)至承包商完成了工程移交證書上注明的、完工日期時尚未完成的所有工作為止。每一份報告應(yīng)包括：

Monthly progress reports shall be prepared by the Contractor and submitted to the Employer?s Representative in six copies. The first report shall cover the period up to the end of the calendar month after that in which the Commencement Date occurred; reports shall be submitted monthly thereafter, each within 14 days o?f the last day of the period to which it relates. Reporting shall continue until the Contractor has completed all work which is known to be outstanding at the completion date stated in the Taking-Over Certificate for the Works. Each report shall include:

向甲方代表提供工程進(jìn)度計劃及收款計劃；

To provide construction progress and payment schedule to Party A’s representative;

進(jìn)度計劃 Progress schedule

乙方應(yīng)按合同條款約定的日期，將施工組織設(shè)計和工程進(jìn)度計劃提交修改意見，逾期不確認(rèn)也不提出書面意見的，視為同意。

Party B shall raise advice on amendments to the construction design program and progress schedule to Party A as per the agreement, if any; if no request for amendment is made as of the stipulated deadline, it shall be regarded Party B has agreed on the construction design program and progress schedule.

乙方必須按甲方代表確認(rèn)的進(jìn)度計劃組織施工，接受甲方代表對進(jìn)度的檢查、監(jiān)督。工程實際進(jìn)度與經(jīng)確認(rèn)的進(jìn)度計劃不符時，乙方應(yīng)按甲方代表的要求提出改進(jìn)措施，經(jīng)甲方代表確認(rèn)后執(zhí)行。因乙方的原因?qū)е聦嶋H進(jìn)度與進(jìn)度計劃不符，乙方無權(quán)就改進(jìn)措施提出追加合同價款。

Party B shall organize for construction as per the progress schedule approved by Party A’s representative and accept the inspection and supervision of Party A’s representative; in case of any discrepancy between the actual progress and the approved progress schedule, Party B shall propose remedy measures as per the requirement of Party A’s representative an implement such measures if approved. In case the discrepancy is caused by Party B, Party B shall have not right to charge any additional contract value regarding the remedy measures taken.

工程的設(shè)計和建造由C實施。每月的第 ____天(如遇節(jié)假日順延)，C應(yīng)向B提出基于上一個月的土建和工程的進(jìn)度報告，這種報告應(yīng)是證明公正性的結(jié)論性證據(jù)，但明顯計算錯誤除外。

Design and Construction of the Project shall be executed by C. At onthly intervals until ____day (subject to postponement in case ____)of each month， C shall execute a statement of a claim for progress payment based on the prices for the construction works done in he preceding month to B and such statement shall be the conclusive vidence proving fairness of such claim except manifest calculation error.

提交在合同規(guī)定的時間內(nèi)進(jìn)度計劃 Programmer to be Submitted

承包商應(yīng)當(dāng)在中標(biāo)函簽發(fā)日之后，以工程師規(guī)定的適當(dāng)格式和詳細(xì)程度， 向工程師遞交一份工程進(jìn)度計劃，以取得工程師的同意。無論工程師何時需要，承包商還應(yīng)以書面形式提交一份對其進(jìn)行工程施工所擬采用的安排和方法的總說明，以供參考。

The Contractor shall, within the time stated in these Conditions after the date of the Letter of Acceptance, submit to the Engineer for his consent a programme, in such form and detail as the Engineer shall reasonably prescribe, for the execution of the Works. The Contractor shall, whenever required by the Engineer, also provide in writing for his information a general description of the arrangements and methods which the Contractor proposes to adopt for the execution of the Works.

無論何時，如果工程師認(rèn)為，工程的實際進(jìn)度不符合第34.1款中已經(jīng)同意的進(jìn)度計劃時，承包商應(yīng)根據(jù)工程師的要求提出一份修訂過的進(jìn)度計劃，表明為保證工程按期竣工而對原進(jìn)度計劃所作的修改。

If at any time it should appear to the Engineer that the actual progress of the Works does not conform to the programme to which consent has been given under Clause 34.1, the Contractor shall produce, at the request of the Engineer, a revised programme showing the modifications to such programme necessary to ensure completion of the works within the Time for Completion.

Article 35 Cash Flow Estimate to be Submitted.

To inspect the construction progress and quality; to inspect and accept the divisional, sub-divisional and concealed works; to evaluate the construction progress

檢查工程進(jìn)度和施工質(zhì)量,驗收分部分項工程和各項隱蔽工程, 對工程進(jìn)度進(jìn)行評估。每周書面向委托人報告工程進(jìn)度，每周組織召開施工例會。

參加甲方組織的施工圖紙或作法說明的現(xiàn)場交底，擬定施工方案和進(jìn)度計劃，交甲方審定。
